Acceptance of Terms

By accessing our facility, participating in our programs, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.

These Terms apply to all users of centurlqaq's services, including members, visitors, and participants in our CrossFit training programs. Your acceptance of these Terms creates a legally binding agreement between you and centurlqaq.

Company Information

Services Description

centurlqaq provides CrossFit training services including but not limited to group classes, personal training, beginner programs, and open gym access. Our services are designed to improve physical fitness through structured exercise programs under professional supervision.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. We may also impose limits on certain features or restrict access to parts or all of our services.

Membership and Registration

To participate in our programs, you must complete our registration process and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

Membership fees are due in advance and are non-refundable unless otherwise specified. We reserve the right to refuse membership or terminate existing memberships at our discretion, particularly in cases of misconduct or violation of these Terms.

Health and Safety Requirements

You acknowledge that participation in CrossFit training involves inherent risks and that you participate at your own risk. You must complete a health questionnaire and provide information about any medical conditions that may affect your ability to exercise safely.

You agree to follow all safety instructions provided by centurlqaq staff and to inform us immediately of any injuries or health issues that arise during or after training sessions.

User Obligations

As a user of centurlqaq's services, you agree to:

• Provide accurate and truthful information during registration and health assessments
• Follow all facility rules, safety guidelines, and instructions from staff
• Treat other members, staff, and the facility with respect
• Use equipment properly and report any damage or safety concerns immediately
• Maintain appropriate hygiene and wear suitable workout attire
• Pay all fees and charges on time
• Notify us of any changes to your health status or contact information
• Not engage in any illegal, harmful, or disruptive behavior

Intellectual Property

All content, materials, and intellectual property associated with centurlqaq, including but not limited to our name, logo, training programs, website content, and proprietary methodologies, are owned by centurlqaq or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of our intellectual property without our prior written consent.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Payment Terms

All fees are stated in Euros and are due in advance. Membership fees are typically charged monthly and are non-refundable. We reserve the right to change our pricing with 30 days' notice to existing members.

Failure to pay fees when due may result in suspension or termination of your membership and access to our services.

Limitation of Liability

To the maximum extent permitted by law, centurlqaq shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services, including but not limited to personal injury, property damage, or loss of profits.

Our total liability to you for any claims arising out of or relating to these Terms or our services shall not exceed the amount you have paid to centurlqaq in the twelve months preceding the claim.

You acknowledge that CrossFit training involves inherent risks and that you participate voluntarily and at your own risk. This limitation of liability applies even if centurlqaq has been advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold harmless centurlqaq, its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of our services, your violation of these Terms, or your violation of any third party's rights.

Termination

Either party may terminate this agreement at any time with appropriate notice as specified in your membership agreement. centurlqaq reserves the right to immediately terminate or suspend your access to our services for any violation of these Terms or for any other reason at our sole discretion.

Upon termination, your right to use our services will immediately cease, and you must return any property belonging to centurlqaq. The provisions of these Terms that by their nature should survive termination shall survive, including but not limited to liability limitations, indemnification, and governing law.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of the Netherlands, and you hereby consent to the personal jurisdiction and venue therein.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and, where appropriate, by email. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

It is your responsibility to review these Terms periodically for changes. If you do not agree to the modified Terms, you must discontinue your use of our services.

Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or our services, the parties agree to first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiations, it shall be resolved through binding arbitration in accordance with the rules of the Netherlands Arbitration Institute.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired, and the invalid provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by centurlqaq, constitute the entire agreement between you and centurlqaq concerning the use of our services and supersede all prior or contemporaneous communications and proposals between you and centurlqaq.
